Control over the execution of a court decision by adopting another court decision on this matter
On July 26, 2023, the Supreme Court, as part of the panel of judges of the Cassation Administrative Court, in case No. 640/17504/19, administrative proceedings No. K/9901/26030/21 (EDRSRU No. 112441459), examined the issue of control over the execution of a court decision by adopting another court decision on this matter.
Court decisions that have entered into legal force are mandatory for execution by all state authorities, local self-government bodies, their officials and employees, individuals and legal entities and their associations throughout the special database territory of Ukraine.

Failure to comply with a court decision entails liability established by law.
Therefore, the mandatory execution of a court decision is an important component of a person's right to a fair trial, guaranteed by Article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms, and one of the basic principles of judicial proceedings, defined by Article 129-1 of the Constitution of Ukraine.
The above conclusions are consistent with the legal position of the Supreme Court expressed in the resolutions of April 23, 2020 in case No. 560/523/19, February 1, 2022 in case No. 420/177/20, and May 18, 2022 in case No. 140/279/21.
